Terms of Service

Welcome to Picksy, Sri Lanka's complete property ecosystem. These Terms of Service ("Terms") govern your access to and use of Picksy's platform, including our websites, mobile applications, and related services (collectively, the "Platform").

By accessing or using Picksy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2.1 Platform Services

Picksy operates as an online advertising and connection platform that brings together property seekers, property owners, service providers, and accommodation hosts across three integrated services:

Picksy Properties

An advertising platform where users can publish postings for buying, selling, renting, or leasing properties. We facilitate connections between buyers, sellers, landlords, and tenants.

Picksy Care

A service marketplace connecting property owners with verified professionals for maintenance and care services including plumbing, electrical work, cleaning, gardening, pest control, security, and other property-related services.

Picksy Stays

An accommodation platform connecting travelers with hosts offering hotels, resorts, villas, guest houses, serviced apartments, and other lodging options across Sri Lanka.

2.2 Platform Provider Only

IMPORTANT: Picksy is a platform provider only. We do not own, sell, rent, or manage properties; employ or directly provide maintenance services; own or operate accommodation establishments; act as a real estate agent, property manager, service contractor, or accommodation operator; guarantee the quality, safety, legality, or accuracy of any posting or services; or participate in or mediate transactions between users.

By accessing or using Picksy's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

These terms constitute a legally binding agreement between you and Picksy. You must be at least 18 years old to use our services.

4.1 Account Creation

You must create an account to access certain features. You agree to provide accurate, current, and complete information; maintain the security of your account credentials; notify us immediately of any unauthorized access; and accept responsibility for all activities under your account.

4.2 Eligibility

You must be at least 18 years old to use Picksy. By creating an account, you represent that you meet this requirement.

4.3 Account Types

Picksy offers different account types for: Property buyers/renters; Property sellers/landlords; Service providers (Picksy Care professionals); Accommodation hosts (Picksy Stays); and General users browsing the platform.

4.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, illegal advertisements, or any other reason at our discretion.

5.1 For Properties (Picksy Properties)

Users posting properties agree to: Provide accurate and truthful information; Have legal authority to post the property; Comply with all applicable laws and regulations; Not engage in fraudulent or misleading practices; Update or remove posts that are no longer available; Respond to inquiries in a timely manner.

5.2 For Service Providers (Picksy Care)

Service providers agree to: Possess necessary licenses, certifications, and insurance; Provide accurate information about services offered; Deliver services professionally and competently; Comply with all applicable safety and industry regulations; Maintain professional conduct with clients; Honor quoted prices and agreed terms.

5.3 For Accommodation Hosts (Picksy Stays)

Hosts agree to: Accurately represent their accommodation; Maintain properties to advertised standards; Comply with local hospitality and safety regulations; Honor confirmed bookings; Provide safe and clean accommodations; Respond promptly to guest inquiries.

5.4 For All Users

All users agree to: Not post false, misleading, or fraudulent content; Respect intellectual property rights; Not harass, abuse, or harm other users; Not use the platform for illegal activities; Not attempt to circumvent platform fees or policies; Maintain professional and respectful communication.

6.1 Prohibited Content

Users may not post content that: Contains false or misleading information; Violates intellectual property rights; Contains discriminatory or offensive material; Promotes illegal activities; Contains malware or harmful code; Violates privacy rights of others.

6.2 Content Removal

Picksy reserves the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

7.1 Platform Fees

Picksy may charge fees for: Premium post placements; Featured property advertisements; Service provider subscriptions; Accommodation booking commissions; Additional promotional services.

7.2 Payment Terms

All fees are clearly displayed before commitment. Payments are processed through secure third-party providers. Fees are non-refundable unless otherwise stated. Users are responsible for applicable taxes.

7.3 Temporary Payment Method

Payments are currently processed via bank transfer as a temporary measure until payment gateways are integrated. Please transfer to the provided account and upload your payment slip for verification.

7.4 Transactions Between Users

IMPORTANT: Picksy does not process payments between users (e.g., property purchases, rental payments, service fees, accommodation bookings). All such transactions occur directly between users and are outside Picksy's control and responsibility.

You retain ownership of content you post but grant Picksy a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the platform.

9.1 Limited Verification

While Picksy may verify certain user information (such as email addresses or phone numbers), we do not: Conduct comprehensive background checks on all users; Verify professional licenses or certifications; Inspect properties or accommodations; Guarantee the accuracy of user-provided information.

9.2 User Due Diligence

Users are responsible for: Conducting their own due diligence; Verifying credentials of service providers; Inspecting properties before transactions; Reviewing accommodation reviews and ratings; Taking appropriate precautions for personal safety.

10.1 Platform "As Is"

Picksy is provided "as is" without warranties of any kind. We do not guarantee: Uninterrupted or error-free service; Accuracy of posts or user information; Quality of properties, services, or accommodations; Successful transactions between users.

10.2 No Liability

To the maximum extent permitted by law, Picksy is not liable for: Disputes between users; Property defects or misrepresentations; Service provider negligence or poor workmanship; Accommodation quality or safety issues; Financial losses from transactions; Personal injury or property damage; Data loss or security breaches; Third-party actions or content.

10.3 User Indemnification

You agree to indemnify and hold Picksy harmless from any claims, damages, or expenses arising from: Your use of the platform; Your violation of these Terms; Your violation of any laws or third-party rights; Content you post on the platform.

11.1 User-to-User Disputes

Picksy is not responsible for resolving disputes between users. Users should attempt to resolve disputes directly or seek legal counsel.

11.2 Governing Law

These Terms are governed by the laws of Sri Lanka. Any legal action must be brought in courts located in Colombo, Sri Lanka.

Picksy reserves the right to modify these Terms at any time. We will notify users of material changes via email or platform notifications. Continued use of the platform after changes constitutes acceptance of the modified Terms.
